We'd do better protecting the First Amendment if we remember what it does – and doesn't - do. The First Amendment restricts only GOVERNMENT action, not that of private institutions or individuals. Sarah Palin has demonstrated her inability to grasp this distinction, but anyone purportedly committing journalism should appreciate it. I'm pretty sure Ave Maria university is not a unit of government (Scalia, Roberts and Alito notwithstanding), and it can be as privately restrictive of the press as it may unwisely choose.
