James Holmes’ defense team will ask Supreme Court to intervene in Jana Winter case

Lawyers for accused Aurora, Colo., theater shooter James Holmes will ask the U.S. Supreme Court to compel Fox News reporter Jana Winter to reveal a source, the Associated Press reports.

The defense wants reporter Jana Winter to identify the law enforcement officials who told her that Holmes sent a notebook containing violent images to his psychiatrist before the 2012 attack.

Holmes’ lawyers say whoever spoke to Winter violated a gag order and should be punished. They also say that officers might have lied when they denied under oath being Winter’s sources, undermining their credibility as potential trial witnesses.

Winter has been fighting the request by Holmes’ attorneys since last year. Last December New York’s highest court said Winter could not be compelled to testify in Colorado. A Colorado legislator’s recent attempt to strengthen his state’s shield law went nowhere.

    Think carefully. A reporter floats a rumor that could be nothing more than a choreographed lie meant to ensure an accused murderer is convicted. Of all the places to be from, she just happens to be from NY which has a law that allows her to conceal the source.

    I understand why many will think there’s nothing unusual going on here. However, if you simply review all of these events backwards from the assumption that the entire case is a fabricated set-up then this reporters actions make a lot of sense.

    Will the source be reveal? Will the notebook prove the accused is guilty? None of this probably matters. You can rest assured that, if the State or any of its 60,000+ departments and agencies has committed unlawful acts relating to the Holmes case they will not admit to it. If any evidence of that is revealed, they will instruct the media to ignore it and that evidence will quickly disappear.
